Employment Equity Commission might enforce stricter penalties on Non Compliant companies.

The Commission on Gender Equality voiced its dismay over the transformation equity targets as publisized by the Employment Equity Commission last week. It seems that companies are still reluctant to transform in top management  categories, especially pertaining to top managment positions for Black Africans, women and employees with disabilities.

According to the Employment Equity Act all designated employers are to plan on transformation targets within their organisations, and report annually or bi-annually on the progress on reaching those targets. Previous fines from R 500 000-00 per transgression did not seem sufficient to enforce the legislative requirments and the CGE is therefor calling for stricter penalties in this regard. A suggestion in this regard is to fine companies 10% of annual turnover as well as prohibit non compliant companies from submitting any tenders for state contracts.

The requirements of the Act is not difficult to comply with and has 4 basic components:

  • Draft a plan in consultation with workers on how to transform the organisation in accordance to a set time frame. The plan has to take cognisance of the available skills in the area, industry type and economically active population.
  • Ensure that all barriers to employment opportunies and dicriminatory measures affecting  previously disadvantaged individuals in an organisation is removed.
  • Ensure that measures is taken to promote affirmative action in the organisation.
  • Report on these measures and targets on an annual or bi-annual basis.
